Terms of Service

Careersome is developed by Wik Immersive, an African artificial intelligence and workforce technology company based in Nigeria. These Terms govern access to Careersome and our related services.

These Terms form an agreement between Careersome and the person or organization using the Service. If you use the Service for an organization, you confirm that you have authority to accept these Terms for it. If you do not agree, do not use the Service.

1. Our Service

Careersome provides artificial intelligence enabled tools for recruitment, workforce management, performance, engagement, onboarding, time off, activities, timesheets, compensation, analytics, employee journeys, and related workflows. Available features and limits depend on your plan, order, or separate written agreement.

We may improve, add, remove, or limit features as the Service evolves. We will give reasonable notice when a material change is likely to substantially reduce paid functionality, unless an urgent security, legal, or operational issue prevents notice.

2. Accounts and eligibility

  • You must be at least eighteen years old and able to enter a binding agreement
  • You must provide accurate and current account information
  • You must protect credentials and promptly report suspected unauthorized access
  • You are responsible for activity performed through your account
  • You may not share an account in a way that defeats security, permissions, or plan limits

3. Organization accounts

An organization controls its workspace, members, roles, permissions, and Customer Content. Administrators may access, export, correct, restrict, or delete information according to their authority. If your account uses an organization controlled email address, the organization may manage that account and its content. The organization is responsible for giving required notices and obtaining required permissions from employees, candidates, and other people whose information it submits.

4. Customer Content

Customer Content means information, files, prompts, records, and other material submitted to the Service, together with results produced from that material. As between Careersome and the customer, the customer retains its rights in submitted content and owns results to the extent permitted by applicable law. You grant Careersome permission to process Customer Content only as needed to provide, secure, support, and improve the Service, meet legal obligations, and follow your instructions.

You confirm that you have the rights and permissions needed to submit Customer Content. We do not use Customer Content to train a general purpose model for use by other customers unless the organization expressly agrees in writing. We may use information that has been aggregated or made anonymous so that it does not identify a person or organization.

5. Artificial intelligence features

Artificial intelligence outputs may be incomplete, inaccurate, outdated, or biased even when they appear confident. Careersome provides recommendations, rankings, summaries, predictions, and generated text as decision support. They are not final employment, legal, medical, or financial decisions.

  • A qualified person must review outputs before they are used in a decision that materially affects a candidate or employee
  • You must consider relevant context and provide a fair way to question or correct important information
  • You must not use the Service for unlawful discrimination, covert surveillance, or a solely automated decision with a significant effect where human review is required
  • You are responsible for testing whether an output is suitable for your purpose and for independently checking important facts

6. Acceptable use

You may not use the Service to break the law, violate another person’s rights, mislead candidates, harass or discriminate, upload malicious code, send spam, gain unauthorized access, evade limits, scrape protected data, reverse engineer the Service, build a competing model from the Service, or resell access without written permission. We may investigate misuse and remove content or restrict access when reasonably necessary to protect people, customers, or the Service.

7. Recruitment and employment decisions

The hiring organization is responsible for job postings, candidate communications, assessments, interviews, employment decisions, workplace decisions, and compliance with applicable labour, equality, and data protection requirements. Careersome does not employ candidates, act as a recruitment agency, or make decisions for the organization.

8. Confidentiality

Each party may receive information that a reasonable person would understand to be confidential. The receiving party will use it only to perform under these Terms, protect it with reasonable care, and share it only with people and providers who need it and are bound to protect it. These duties do not cover information lawfully known without restriction, independently developed, or made public without breach. A legally required disclosure may be made after notice where notice is permitted.

9. Privacy and security

Our Privacy Policy explains how we handle personal information. When Careersome processes personal information for an organization, the organization generally decides why and how it is used and Careersome acts on its documented instructions. We use reasonable technical and organizational safeguards, but no system can guarantee absolute security.

10. Our technology and your licence

Careersome and its licensors own the Service, software, designs, documentation, branding, and related technology. Subject to these Terms, we give you a limited, revocable, nonexclusive right to use the Service for your permitted internal purposes during your subscription or authorized access. No other rights are granted.

11. Fees and subscriptions

Paid plans are governed by the prices, billing cycle, taxes, usage limits, cancellation terms, and renewal information shown when you purchase or stated in an order. You authorize recurring charges when you choose a renewing subscription. Except where applicable law or a written agreement requires otherwise, fees already earned are not refundable. Failure to pay may result in restriction or suspension after reasonable notice.

12. Third party services

The Service may connect to hosting, payment, authentication, communication, analytics, or artificial intelligence providers. Those services may have their own terms and privacy practices. We are not responsible for a third party service that you choose to connect, but we remain responsible for selecting and overseeing providers that process information for us as required by applicable agreements and law.

13. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access for material breach, nonpayment, security risk, unlawful use, harm to others, or a legal requirement. Where the issue can be corrected, we will normally give notice and a reasonable opportunity to correct it. After termination, access ends and data is handled according to the Privacy Policy, the organization’s instructions, and applicable retention duties.

14. Warranties and liability

The Service is provided as available. To the fullest extent permitted by applicable law, we disclaim implied warranties and do not promise that the Service or any artificial intelligence output will always be accurate, complete, secure, uninterrupted, or suitable for a particular purpose.

To the fullest extent permitted by applicable law, neither party is liable for indirect, incidental, special, exemplary, or consequential loss, or for lost profits, revenue, goodwill, or data. Careersome’s total liability arising from the Service will not exceed the fees paid for the affected Service during the twelve months before the event giving rise to the claim. These limits do not apply where liability cannot lawfully be limited.

15. Indemnity

You will defend and indemnify Careersome against a third party claim arising from Customer Content, your unlawful use of the Service, or your material breach of these Terms. This duty applies only when we promptly notify you, reasonably cooperate, and allow you to control the defence, subject to our right to reject a settlement that admits fault or imposes an ongoing obligation on us.

16. African digital rights principles

As an African artificial intelligence company, we design our governance with reference to the African Union Convention on Cyber Security and Personal Data Protection, the African Union Data Policy Framework, the African Charter on Human and Peoples’ Rights, and the African Union Continental Artificial Intelligence Strategy. These instruments guide our approach to dignity, fairness, privacy, security, transparency, accountability, inclusion, and meaningful human control. They do not replace any mandatory law that applies to you or to us.

17. Disputes and applicable law

A party must first give written notice of a dispute and allow thirty days for good faith resolution. If it remains unresolved, either party may use any court or agreed arbitration forum with lawful jurisdiction. These Terms are interpreted under the mandatory laws that apply to the parties and the Service. Nothing in these Terms removes consumer, employment, privacy, or human rights protections that cannot lawfully be waived.

18. General terms

These Terms, any applicable plan terms, and any signed agreement form the complete agreement for the Service. A signed agreement controls if it conflicts with these Terms. If one provision is unenforceable, the remaining provisions continue. A delay in enforcement is not a waiver. Neither party is liable for delay caused by events beyond reasonable control.

We may update these Terms to reflect changes to the Service, law, safety, or business operations. Material changes take effect after reasonable notice unless an urgent legal or security need requires earlier effect. Continued use after the effective date means you accept the revised Terms.
